Welcome to WhileYouWork (whileyouwork.co). These Terms and Conditions ("Terms") govern your access to and use of our website and services. By using our site or services, you agree to these Terms. If you do not agree, please do not use our site or services.

1. Use of Our Services

WhileYouWork provides marketing automation, customer relationship management, and communication tools to small businesses. You may use our services only for lawful purposes and in accordance with these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account and for all activities under your account. You agree to provide accurate information and to notify us of any unauthorized use.

3. Fees and Payment

Our services are offered on a subscription basis at the rates communicated to you at signup. Monthly fees are billed automatically and will continue until cancelled. One-time setup fees are due upon signing. All fees are non-refundable except where required by law.

4. Cancellation

You may cancel your subscription at any time with thirty (30) days' written notice. We may also terminate service for breach of these Terms or for non-payment.

5. SMS Messaging Program Terms

Program Name: WhileYouWork

Eligibility

You must be 18 years of age or older to use this SMS service.

By opting in to the WhileYouWork SMS messaging program, you consent to receive text messages from WhileYouWork. Messages may include appointment confirmations, lead follow-up messages, review requests, service updates, customer support responses, and other communications related to the services you have opted in to.

Opt-Out Instructions

You can cancel the SMS service at any time. Simply text STOP to the shortcode. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.

Rejoining Instructions

To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message and Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

Privacy

Compliance

WhileYouWork complies with industry standards for SMS messaging, including guidelines set forth by the Cellular Telecommunications Industry Association (CTIA) and all applicable federal and state laws, including the Telephone Consumer Protection Act (TCPA).

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. Acceptable Use

You agree not to use our services to:

Send unsolicited messages or spam to individuals who have not consented to receive them.

Send messages containing illegal, fraudulent, or harmful content.

Engage in phishing, smishing, or social engineering.

Send content that violates carrier policies, including SHAFT content (sex, hate, alcohol, firearms, tobacco) that does not follow federal and state law.

Harass, defame, or infringe the rights of others.

Violations may result in suspension or termination of service, and may subject you to carrier fines that will be passed through to you.

7. Intellectual Property

All content on our website is owned by WhileYouWork or its licensors and is protected by copyright and other intellectual property laws. You retain ownership of the data you provide through our services.

8. Limitation of Liability

To the fullest extent permitted by law, WhileYouWork's total liability for any claim will not exceed the fees paid in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.

10. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of the updated Terms.
